We know that there is a huge amount of interest in news about a Digital Millennium Copyright Act (DMCA) notification submitted to Linden Lab against us. We are writing this update to keep you as informed as possible with the latest news.

To recap, on December 1, 2014, we received a notification from Linden Lab saying that a DMCA notification had been submitted to Linden Lab. Linden Lab said that the DMCA notification claimed we had infringed on copyrighted works in Second Life. The Belleza hands, however, are the original content of Tricky Boucher and therefore the notification is incorrect.

Last week, we hired an attorney and worked with him to respond to the DMCA notification. On December 9th, our attorney submitted a DMCA counter-notification to Linden Lab. The DMCA counter-notification states that “the material identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.” After submitting the counter-notification, and by early evening, Linden Lab sent us a copy of the original DMCA notification that was filed against for us to review.

We reviewed the DMCA notification and then contacted the person named as the claimant in the notification. The person named in the notification told us that the person had not filed a DMCA against Belleza and claimed no ownership in the Belleza hands. For these reasons, we believe that not only was the DMCA notification incorrect, the notification was fraudulent and the claimant had impersonated the person named in the notification. At this time, we are not disclosing the person named in the DMCA notification, because that person is not a Second Life user and was impersonated.

Our attorney is currently in the process of speaking with Linden Lab regarding how we can proceed to quickly have the Venus body placed back in-world for sale.

We want to thank everyone for their patience with the process and your understanding that we are working to handle this in the best way possible.

We have received such a huge outpouring of support during this last week that it is truly overwhelming. It is amazing to be part of a community that stands by each other in difficult times, and we cannot thank you all enough for all of the kind words.

Please know as soon as we have more information and or the body is back in-world, we will post an update on our blog.

    Since these complaints are done electronically on the Second Life website, Linden Labs can surely find out who actually submitted the complaint. (I.P. addresses, etc.) A subpoena by Belleza’s attorney could possibly unearth this. Then a civil suit could be filed, if not criminal charges of fraud.

    Very good news! And it includes a valid advice for everyone who will become a victim of such DMCA bully methods in the future, and the advice is: COUNTER FILE. If everyone does so, then these brainless attackers will be spotted, prosecuted and hit by the law sooner or later.
